These Terms of Service (“Terms”) constitute a legally binding agreement between you (“Customer,” “You”) and Lilacs and Lemons Farmhouse Bakery (“Bakery,” “We,” “Us,” or “Our”) governing your use of our products, services, website, and transactions.

By purchasing, consuming, or accessing any goods or services from Lilacs and Lemons Farmhouse Bakery, you acknowledge that you have read, understood, and agreed to be bound by these Terms.

1. PRODUCTS & SERVICES

All items sold by the Bakery are food products made in compliance with Missouri Cottage Food Laws and/or licensed food preparation guidelines. Our items are handcrafted, made-to-order, and perishable. The Bakery offers no guarantees regarding individual customer preferences, taste, or aesthetic expectations.

2. PRICING & PAYMENT

All prices are listed in U.S. Dollars and are subject to change without notice. Payment is due at the time of order, unless otherwise agreed to in writing. Accepted payment methods include cash, Venmo, Square, Shopify POS, PayPal, CashApp, and other pre-approved methods.

3. NO REFUNDS / NO RETURNS

All sales are final. Due to the nature of our products, we do not accept returns or issue refunds under any circumstances. This includes cancellations due to:

  • Weather or natural disaster

  • Illness, injury, or death

  • Scheduling conflicts

  • War, epidemic, or pandemic

  • Shipping delays or damage

  • Dissatisfaction with taste, appearance, or texture

4. FOOD ALLERGIES & DIETARY RESTRICTIONS

Our products are made in a kitchen that uses ingredients including but not limited to: dairy, eggs, soy, gluten-free grains, peanuts, tree nuts, and coconut. Although we make every effort to avoid cross-contact, we do not guarantee an allergen-free environment.

Customers must disclose any allergies at the time of order. Lilacs and Lemons Farmhouse Bakery is not liable for illness or injury caused by failure to disclose allergies or dietary needs.

5. SHIPPING & DELIVERY

Risk of loss and damage passes to the Customer once the order leaves our possession. We are not liable for delays, damage, or loss caused by third-party carriers, environmental conditions (e.g., heat or cold), or improper handling once the product has left our premises.

6. INTELLECTUAL PROPERTY

All content, packaging designs, branding, photos, and written materials provided by Lilacs and Lemons Farmhouse Bakery remain the exclusive intellectual property of the Bakery and may not be copied, reproduced, or used without express written permission.

7. WAIVER OF LIABILITY

By purchasing, accepting delivery, or consuming our products, you voluntarily waive and release Lilacs and Lemons Farmhouse Bakery, its owners, agents, and employees from any and all claims, including but not limited to:

  • Personal injury or illness

  • Property damage

  • Death

  • Allergic reaction or foodborne illness

  • Misuse or mishandling of products by customer or third party

8. LIMITATION OF LIABILITY

To the maximum extent permitted by law, Lilacs and Lemons Farmhouse Bakery shall not be liable for any indirect, incidental, consequential, or punitive damages, even if we were advised of the possibility of such damages.

9. DISPUTE RESOLUTION & GOVERNING LAW

Any dispute arising under or in connection with these Terms shall be governed by the laws of the State of Missouri. All claims must be brought exclusively in the courts located in Clay County, Missouri. Both parties waive any right to trial by jury.

10. MODIFICATIONS

We reserve the right to modify or update these Terms at any time without prior notice. Continued use of our products or services after any changes constitutes acceptance of the revised Terms.
